Terms and Conditions
ย
1. Who we are and agreeing to these terms
These terms are an agreement between you and Arise Coaching and Retreats, LLC ("Arise," "we," "us"), founded by Amanda Hope Kendall. They apply whenever you buy, join, attend or use anything we offer, including through our website, Kajabi, or the Arise app.
You accept these terms when you tick the agreement box at checkout, sign an enrollment or retreat form, or use our services. If you don't agree, please don't purchase or participate.
You must be at least 18 years old to register yourself. A minor may take part only if a parent or legal guardian registers them, signs all required documents on their behalf, and accepts these terms for them.

3. Coaching is not therapy, and results are yours
Coaching is a partnership focused on your present and future goals. It is not therapy, counseling, psychological treatment, or medical, legal or financial advice, and it does not replace any of them. Arise's founder and coach, Amanda Hope Kendall, holds a Bachelor's degree in Family and Human Services. She is not a licensed therapist, counselor or medical professional.
Our work draws on ideas from fields like nervous-system regulation and parts work (the BNACTS Steadfast Path). We use these as coaching and self-reflection tools, not as clinical treatment.
- Your care comes first. If you are under a doctor's or therapist's care, please keep that care in place and tell us if anything in our programs conflicts with it.
- Crisis support. We are not a crisis service. If you are in danger or thinking about harming yourself, call 911 or call or text 988 (Suicide & Crisis Lifeline, US).
- You make your own choices. You are responsible for your decisions, actions and results during and after coaching.
- No guaranteed outcomes. We can't promise any particular result. Testimonials reflect individual experiences, not typical or guaranteed results.
- We may refer you out. If we believe you need support beyond coaching, we may recommend a licensed professional and pause or end coaching. Any refund follows the Refund Policy.
4. Payments and refunds
Prices are listed in [US dollars] at checkout and are processed through Kajabi and its payment partners. We don't store your full card details.
- Pay in full or by payment plan. A payment plan is a way to spread the full program price, not a monthly subscription. If you choose a plan, you agree to pay the full price even if you stop participating.
- Missed payments. If a payment fails, we'll let you know and retry. If it isn't resolved within 7 days, we may pause your access until your account is current.
- Chargebacks. Please contact us before disputing a charge with your bank. An unwarranted chargeback may end your access to current and future programs.
- Price changes. We may change prices for future purchases. Your price is locked once you enroll.
- Refunds, credits and transfers are governed only by the Arise Refund and Cancellation Policy, including its cancellation windows, the non-refundable 25% retreat deposit, and payment plan rules. Where the two documents differ on refunds, the Refund and Cancellation Policy wins.
5. Sessions, scheduling and program length
- Rescheduling. Give at least 24 hours' notice to reschedule a 1:1 session. Sessions cancelled with less notice, or missed, count as used.
- Lateness. If you're late, the session still ends at its scheduled time.
- If we need to reschedule, we'll give as much notice as we can and offer a new time. Sessions we cancel are never counted as used.
- Use within the program window. Sessions must be used within the program period (for example, 12 weeks for Calibrated) plus a 2-week grace period. Unused sessions expire after that.
- Group calls run as scheduled whether or not you attend. Replays are provided [when available].
- Access to digital content lasts [for the life of the program / 12 months / as stated on the sales page].
6. Retreats, equine sessions and in-person events
In-person offerings take place outdoors and may include hiking, uneven terrain, high altitude, cold water, weather, wildlife, and working around horses. Horses are large animals that can act unpredictably, even when calm and well trained.
- Separate waiver required. Every retreat, equine session, outdoor program and in-person event requires a signed Release of Liability and Assumption of Risk before you take part.
- Health disclosure. You agree to complete our health and fitness questionnaire honestly and to tell us about medical conditions, allergies, medications, injuries or pregnancy that could affect your safety. Talk to your doctor before attending if you have any concerns.
- You choose your level. Every activity is optional. You may sit out or modify anything at any time, and we may ask you to sit out an activity if we believe it's unsafe for you.
- Follow safety instructions from Arise staff, facilitators and horse handlers at all times.
- Emergencies. You authorize us to seek emergency medical care for you if needed. You are responsible for any medical costs.
- Travel and insurance. Unless the sales page says otherwise, you arrange and pay for your own travel to the venue. We recommend travel insurance, since retreat refunds follow the Refund Policy.
- Substances. No recreational drugs during program activities. Arise never serves alcohol. At some paint nights or events, an independent venue or licensed vendor may sell or serve it; that vendor alone is responsible for serving, checking that guests are 21 or older, and following the law. Please drink responsibly and never drive impaired.
- Program changes. Weather, venue or safety issues may require us to change the schedule, activities or location. If we cancel a retreat ourselves, you can choose a full refund or a full credit. If we must postpone for reasons outside our control, we'll offer a new date or a credit, as set out in the Refund and Cancellation Policy.
7. Confidentiality
We keep what you share in coaching private. We won't share your personal information or what you discuss without your permission, except:
- when we believe you or someone else is at risk of serious harm,
- when we're required to by law, a court order or subpoena,
- when we suspect abuse or neglect of a child or vulnerable adult.
Coaching conversations aren't covered by the legal privilege that applies to doctors, therapists or lawyers.
In groups and retreats, you agree to keep other participants' names, stories and personal details private. Share your own experience freely, but not anyone else's. We ask everyone to honor this, but we can't guarantee every participant will.
8. Our content, your account and the Arise app
All Arise materials belong to Arise or its licensors. That includes the BNACTS Steadfast Path framework, program curricula, workbooks, videos, recordings, worksheets, paintings and prompts, the podcast, the app, and the Wildly Rooted memoir.
- Your license. When you buy a program, you get a personal, non-transferable license to use its materials for your own growth.
- Please don't copy, resell, share logins, post our materials publicly, or use them to coach or teach others without written permission.
- Your account. Keep your Kajabi and app login private. You're responsible for activity on your account. We may suspend accounts that are shared or misused.
- Your content. You own what you share (journal entries, posts, artwork). By posting in a community space, you allow us to display it there so the program can run.
- Availability. We work to keep the app and online content available but can't promise uninterrupted access. We may update or retire features.
9. Code of Conduct and removal
Every participant commits to the Arise Code of Conduct: authentic connection over being right, caring for your health and wellness, honesty despite fear of judgement, and willingness to do the work.
We also expect respect for everyone in the space. Harassment, discrimination, threats, violence, being under the influence during activities, or sharing others' private information is not allowed.
We may remove you from a session, group, community or retreat if your behavior puts others at risk or seriously disrupts the program. Removal for a conduct violation is not eligible for a refund, as stated in the Refund Policy. [At retreats, you'd also be responsible for your own early travel home.]
10. Recordings, photos and testimonials
- Session recordings. We record all 1:1 and group sessions, and by enrolling you consent to being recorded. 1:1 recordings are shared only with you. Group recordings are shared only with members of that program. Recordings are stored securely, used only to deliver your program, and kept for 12 months after it ends. We never use them in marketing without your written permission. In group calls, you may turn off your camera or use a first name only.
- Retreat and event photos. We may take photos or video at in-person events for marketing. You can opt out on your registration form or by wearing an opt-out lanyard at the event, and we won't feature you.
- Testimonials. We'll only publish your words, name or image with your written permission. You can ask us to remove them later, and we'll do so from places we control.
- Podcast. Guests sign the Arise Podcast Guest Release before recording. We won't share a client's story on the podcast without their written consent.
11. Privacy and communications
We collect only the information we need to deliver our programs, take payment and keep you safe, such as your contact details, health questionnaire answers for in-person events, session recordings, and your progress in the app. We never sell your personal information. Details are in our Privacy Policy.
By enrolling, you agree we may email or message you about your program. You can unsubscribe from marketing emails at any time; program-related messages continue while you're enrolled.
12. Disclaimers and limits of liability
- As-is services. Our programs and content are provided "as is." To the extent the law allows, we make no warranties beyond those stated in these terms.
- Limit on our liability. To the extent the law allows, Arise's total liability for any claim is limited to the amount you paid for the specific program the claim relates to. We aren't liable for indirect or consequential losses, such as lost income or opportunities.
- Your responsibility. You agree to cover losses or claims caused by your breach of these terms, your conduct, or your misuse of our materials.
- Events outside our control. We aren't responsible for delays or cancellations caused by events beyond our reasonable control, such as wildfire, severe weather, illness, natural disasters, government orders, or internet and platform outages. Affected programs follow Section 5 of the Refund and Cancellation Policy (new date or credit).
- Nothing in these terms limits liability that can't legally be limited, such as for gross negligence.
13. Disputes, changes and contact
- Talk to us first. If something goes wrong, please contact us. We'll try in good faith to resolve it within [30] days before either side takes formal action.
- Governing law. These terms are governed by the laws of the State of Idaho, and any dispute will be handled in the state courts of Caribou County, Idaho [or by mediation first].
- Changes. We may update these terms. The version in effect when you purchased applies to that purchase. We'll post updates on our website with a new effective date.
- If part of these terms is unenforceable, the rest still applies.
